Terms of Service.
By using NotePub you agree to be bound by these Terms of Service. NotePub can amend these Terms of Service at any time with immediate effects. It is your sole responsibility to periodically check for changes in these Terms of Service.

1. Age. NotePub is not intended for use by anyone under the age of 13. By accessing NotePub, you represent that you are 13 years of age or older. In the event that we learn that a user account is owned by a child under age 13, we will delete all information related to such account as quickly as possible. Additionally, it is a breach of these terms of service for a user under age 18 to disclose, through the use of NotePub, any personal information such as contact details, age, gender, location, and real identity.

2. Passwords. You are responsible for safeguarding the passwords that you use to access any secure areas of NotePub. You agree to assume all risks and take sole responsibility for any usage under your user name and password, whether or not you have authorized such usage. NotePub does not store unencrypted passwords, and does not have the means to recover lost passwords.

3. Liability. NotePub merely provides the means for its users to publish information on the internet, and does not monitor, review, approve, or endorse the content published by its users. Therefore, by submitting content to NotePub you take full responsibility and assume liability for any illegal activity, including, but not limited to: copyright violation and piracy, damages to the right to privacy of third parties (such as publishing the contact information and personal details of third parties), the distribution of potentially damaging software such as computer viruses, and the publishing of content that is defamatory, libelous, hateful, misleading, deceptive, offensive, threatening, harassing, or damaging in any way to any third party. You agree to indemnify NotePub from any costs, including but not limited to, attorney's fees and compensation to third parties, arising out of your usage of NotePub.

If you believe that you are somehow damaged by content published in NotePub, you can immediately cut public access to said content using the ban button in the NotePub user interface. NotePub does not accept responsibility for any of your actions as a user, including but not limited to, the censoring, banning, or deletion of third party content.

4. Warranties. No warranties are made about the fitness of NotePub for any purpose or about the veracity of the information published by users through NotePub. No warranties are made about Notepub's capacity to enforce private access controls. No aspect of NotePub is warranted to be available, reliable, or functional. NotePub is provided "as is". Use at your own risk.

NotePub reserves the right to change or delete any content or user account and terminate all services, at its sole discretion, without compensation or previous warning.

In the event that we learn that a user account is owned by a convicted sex offender, we will delete all information related to such account as quickly as possible.

5. Privacy policy.

NotePub does not store private or confidential Personally Identifiable Information about its users. It is against these terms of service to use NotePub to store private or confidential Personally Identifiable Information about third parties without using encryption. The NotePub web interface allows to encrypt text before it is sent to NotePub. No warranties are made about the encryption method provided by NotePub. Users can use other third party encryption tools before submitting sensitive data to NotePub. NotePub does not store or have access to the passwords used for encryption, as all encryption/decryption occurs locally in the client computer. NotePub will not (and in practice can not) search or decrypt text encrypted by the users. Any other data that has not been encrypted, including public and private notes, files, and pictures, may be examined by NotePub employees with the sole purpose of verifying compliance with these terms of service. Please note that files and pictures are never encrypted by NotePub, only the links pointing to their location are. Users can use third party encryption tools to encrypt files and images before uploading. Please be aware that under certain circumstances any web service provider might be legally obliged to reveal private user information to the authorities. In no other case will your private information be shared with any third party without your explicit permission.

NotePub does not collect personal information without your prior and explicit consent. You can, at your own risk, use NotePub to store personal information, using encryption when appropriate. Although our best efforts are made to enforce your choice of privacy settings, please be aware that no security measures are perfect or impenetrable. Therefore, we cannot and do not guarantee that the information you provide to NotePub will not be viewed by unauthorized persons. NotePub should not be used to store unencrypted data that could be of any use to malicious internet users, such as email addresses and credit card numbers.

Internet Protocol numbers are broadcast in every internet communication. NotePub stores such Internet Protocol numbers to protect NotePub from malicious internet activity.

NotePub stores in your computer a session cookie with the sole purpose of you not having to constantly type your user name and password. The information stored in such cookie is a session code that expires in matter of a few hours/days (that is why you have to occasionally re-type your name and password). NotePub also stores a second cookie with your preferences for the background color and font for the website. These cookies do not contain any information about you. The only privacy concern here is that someone with access to your filesystem can, by detecting the presence of such cookies, determine that someone using your computer has visited NotePub.com before. If that is a concern, you can delete such cookies after your usage of NotePub. Please refer to your browser documentation for instructions to block or delete cookies.

NotePub also uses local storage technology built in modern browsers to autosave the contents and settings of your note editor so no information is lost in case of a crash or you accidentally navigating away from NotePub.

6. Copyright policy.

By submitting content to NotePub, you warrant that you are the author or owner of the intellectual property rights of the submitted content, and retain such rights, but you grant NotePub the right to modify and reproduce by any means the submitted content without compensation. Usage of NotePub to transmit information in a way that violates intellectual property rights is prohibited. Infringing material is promptly removed or disabled and the accounts of repeat infringers are terminated in accordance with the Digital Millennium Copyright Act.
If you believe that material is accessible on the NotePub website in violation of your copyright, you may disable access to such material by using the ban button in the NotePub user interface. You can also submit a written communication as set forth in the Digital Millennium Copyright Act ("DMCA"), 17 U.S.C. ยง 512(c)(3) including the following information:

- Identify the material or content related to the alleged copyright infringement.
- Identify the URL or location on the NotePub website that contains the material that you claim infringes your copyright.
- Provide the electronic or physical signature of the owner of the copyright or a person authorized to act on the owner's behalf.
- Include a statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
- Include a statement by you that the information contained in your Notice is accurate and that you attest under the penalty of perjury that you are the copyright owner or that you are authorized to act on the copyright owner's behalf.
- Include your name, mailing address, telephone number and email address.
You may submit your Notification of Alleged Copyright Infringement using this form.

If you believe your own copyrighted material has been removed from NotePub.com as a result of mistake or misidentification, you may submit a written Counter Notification including the following:

- Identification of the material that has been removed or disabled and the location at which the material appeared before it was removed or disabled.
- A statement that you consent to the jurisdiction of the Federal District Court in which your address is located, or if your address is outside the United States, for any judicial district in which the service provider may be found.
- A statement that you will accept service of process from the party that filed the Notification of Alleged Copyright Infringement or the party's agent.
- Your name, address and telephone number.
- A statement under penalty of perjury that you have a good faith belief that the material in question was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
- Your physical or electronic signature.

You may submit your Counter Notification by using this form.
Please note that if you materially misrepresent that the disabled or removed content was removed by mistake or misidentification, you may be liable for damages, including costs and attorney's fees.
